Terms of use

360sona is a free, non-commercial hobby project. It is provided as is, it can disappear without warning, and the artwork in it is not ours to license to you.

Plain summary, which is not a substitute for the terms. Use it for fun. Do not attack it or the people on it. Do not upload anything you would not want a stranger to see. Your avatars live in your account and can be deleted at any time, including by accident. Microsoft owns the items; an export is for your own use. Nobody here promises the service will work, stay up, or keep your data, and nobody here is liable if it does not.

1. Who this is between

"360sona", "the service", "we" and "us" mean this website and the person who runs it. "You" means whoever is using it. By loading the site you accept these terms. If you do not accept them, do not use it.

2. What the service is

360sona is an independent reimplementation of the avatar editor Microsoft shipped on the Xbox 360. It runs in your browser. It lets you assemble an avatar out of items from the original catalogue, pose and photograph it, and export models.

It is a personal project maintained in someone's spare time, at their own expense, with no company behind it, no support desk, and no revenue.

3. Age

If you are under the age at which you can agree to terms like these where you live, you need a parent or guardian to agree on your behalf. The service is not aimed at young children and does not knowingly collect anything from them; it asks for no personal information at all beyond a username you choose. If you believe a child has provided something that should not be here, get in touch and it will be removed.

4. Your account

An account is a username and a password. There is no email address on file. That is a deliberate privacy decision and it has one hard consequence: there is no password reset. The recovery words shown once when you sign up are the only way back in. If you lose both the password and the words, the account and everything in it are gone permanently, and nobody here can recover them, because what is stored is a hash rather than the secret itself.

You are responsible for what happens under your account. Keep your credentials to yourself. Tell us if you think somebody else has them.

We may suspend or remove an account that is being used to attack the service, to harass other people, to break these terms, or to break the law. Where it is reasonable to warn you first, we will.

5. What you may not do

Attack, overload, probe or disrupt the service, its servers, or anyone else using it. This includes automated scraping at a rate that degrades it for others.
Try to reach accounts, data or parts of the system that are not yours.
Circumvent rate limits, authentication or any other control, or help anyone else do so.
Upload, submit or create content that is unlawful, that harasses or threatens somebody, that impersonates a real person in order to deceive, or that sexualises minors.
Use the service to infringe someone else's rights, or to redistribute the catalogue's assets as if they were yours to give away.
Present the service as official, endorsed, or connected to Microsoft, or use it in a way that suggests it is.

6. Content you submit

The only things you can submit are a username, the avatars you assemble, slot names you type, and bug reports. You keep whatever rights you have in them. You grant us permission to store and process them for the sole purpose of running the service, which is what makes it possible to show you your own avatars on your next visit.

You confirm that what you submit is yours to submit and does not break clause 5. We may remove content that does, and may do so without notice where it is unlawful or harmful.

7. The catalogue is not ours

Every item, texture, animation and piece of artwork in the catalogue was created by Microsoft Corporation and its partners and licensors. They are the rights holders. Nothing in these terms, and nothing the service does, grants you any licence to that material. 360sona is not affiliated with, endorsed by, sponsored by, or connected to Microsoft in any way. "Xbox", "Xbox 360" and "Xbox Avatars" are their marks, used here descriptively to say what this is a reimplementation of.

The code that makes up 360sona is a separate, independent work and is not Microsoft's.

Exports are provided for personal, non-commercial use: looking at your own avatar, opening it in a 3D tool, learning how the format works. If you want to use an export commercially, in a game, or anywhere that matters, that is a question for the rights holder and not for us, and you should assume the answer is no until they tell you otherwise. You are responsible for how you use anything you download.

If you are a rights holder and something here should not be, contact us and it will be dealt with promptly.

8. Availability, and losing things

There is no uptime commitment of any kind. The service may be slow, unavailable, broken, changed, or permanently shut down, at any time, without notice and without any obligation to keep running it or to preserve what is in it.

Assume your data can be lost. Saved avatars live on a server run as a hobby. Backups are not guaranteed. Bugs, hardware failure, a mistaken migration or the project ending are all real ways for an account to disappear. If an avatar matters to you, export it and keep the file somewhere you control.

9. Changes to the service and to these terms

Features may be added, changed or removed. These terms may change; the date at the foot of the page says when they last did, and continuing to use the service after a change means you accept the revised version. Where a change is significant we will try to say so on the site.

10. No warranty

The service is provided "as is" and "as available", with no warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that it will be uninterrupted, secure, error-free, or that any defect will be corrected, or that files it produces are fit for any particular use.

11. Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or exemplary damages, or for any loss of data, avatars, goodwill, profits or opportunity, arising out of or connected with your use of the service, whether the claim is in contract, tort (including negligence), or anything else, and whether or not we were told such damage was possible.

Where liability cannot lawfully be excluded, it is limited to the greater of the amount you have paid to use the service, which is nothing, or the smallest sum the applicable law permits.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities. Where that is so, the exclusions and limits above apply only as far as that law permits, and nothing here removes any right you have that cannot be removed by agreement, including rights against fraud, or for death or personal injury caused by negligence.

12. Indemnity

You agree to indemnify and hold harmless the operator of 360sona against claims, damages and reasonable costs arising from your breach of these terms, your misuse of the service, or your use of anything you export from it in a way clause 7 does not permit.

13. Ending it

You may stop using the service at any time. To have an account and its contents deleted, ask via the contact page. We may suspend or end your access under clause 4. Clauses 7, 10, 11 and 12 survive the end of your use of the service.

14. Third parties

Links from this site to anywhere else are for convenience. We do not control those places and are not responsible for them.

15. General

If any clause here is found unenforceable, the rest continues in force and that clause is narrowed to the minimum extent needed to make it valid. Not enforcing a term on one occasion does not waive it. These terms, together with the privacy notice, are the whole agreement between us about the service. You may not transfer your rights under them; we may transfer ours if the project changes hands, on the same terms.
